PPC30 - Nelson Airport Runway Extension and Notice of Requirement

Status: Operative

The following private plan change was made Operative and has been incorporated into the Nelson Resource Management Plan (NRMP), and thus now has full legal effect. In addition, the following Notice of Requirement has been incorporated into the NRMP and has full legal effect.

Main Changes

Private Plan Change 30

Nelson Airport Limited introduced this private plan change as a long term, integrated planning solution with the purpose of:

• providing a clear planning framework regarding activities anticipated within the Airport designations
• ensuring the contemporary role and function of the Airport, in terms of its strategic importance to the Nelson-Tasman region and the country, is recognised; and
• providing a consistent approach to managing activities sensitive to airport noise in order to manage reverse sensitivity effects and ensure communities around the Airport are developed with healthy living environments.

Minor corrections were also incorporated into the Nelson Resource Management Plan in accordance with Clause16, Schedule 1 of the Resource Management Act. These amendments provide for the following:

1. Minor errors
2. Typos and grammar including: Improvements to readability, coherence and implementation
3. ePlan compatibility

None of the minor corrections made any material changes to the plan change provisions. A complete list of the changes to the provisions can be read here.

Key provisions of the private plan change included the formation of Chapter 15 Airport Zone, and associated provisions for land contained within designation DAA1, as proposed in the Notice of Requirement, including three zone precincts:

• the core Airport precinct (including runway, airfield, taxiways and other aviation activities),
• the Airport environs precinct (providing for business activities supporting and complementing the Airport), and
• the Airport coastal precinct (the coastal and river margins).
• Amendments to Chapter 5 District Wide provisions to strengthen the role and function of Nelson Airport as nationally and regionally significant infrastructure and incorporate policy related to managing reverse sensitivity effects on Nelson Airport.
• Amendments to Chapter 11 Industrial provisions to remove redundant provisions that relate to Nelson Airport.
• Amendments to Chapter 7 Residential, Chapter 9 Suburban Commercial, Chapter 10 Industrial, Chapter 11 Open Space and Recreation, and Chapter 14 Conservation Zones to provide a consistent rule suite to manage activities sensitive to airport noise within the Airport Effects Control Overlay and Airport Noise Boundary.
• Amendments to Appendix 19 Acoustic Insulation Requirements in relation to the amended Airport Effects Control Overlay and inclusion of updated Future Air Noise Contours, and addition of ventilation requirements.
• Inserted and amended definitions to Chapter 2 Interpretation to provide for the above.
• Consequential amendments to Chapter 3 Administration.

s181 (Alteration of a Designation) - Notice of Requirement (NoR)

As a Requiring Authority under the Resource Management Act 1991 (RMA), Nelson Airport Limited (NAL) is able to alter it’s designations in the NRMP. NAL is able to do this via a Notice of Requirement under Section 181 of the RMA. Council received a Notice from NAL that sought to alter Designations DAA1, DAA2 and DAA3 in Appendix 24 and on the planning maps in the NRMP to provide for the construction, operation, use and maintenance of the northern runway extension to Nelson Airport, with associated amendments to the airport’s Airnoise Boundary (ANB) and responsibilities for aircraft noise and to the Airport Height Restrictions (or Obstacle Limitation Surface (OLS)).

• DAA1 Aerodrome (Nelson Airport) protects the operational capability of the airport and provides for associated development of aviation and ancillary activities. The spatial extent of DAA1 is to be amended to enable extension of the existing main runway to the north, and to land that NAL owns east of Jenkins Creek. The designation was also amended to update its purpose, to confirm the nature of works, activities and facilities authorised and associated with the airport, and to clarify the conditions associated with the designation, in particular those required in establishing the northern runway extension.
• DAA2 Airnoise Boundary Controls imposes limits on the level of aircraft noise that the airport can generate. The spatial limit of the ANB is to be updated based on contemporary modelling, fleet mix, growth projections and, as with the OLS, a composite of future activity on the main existing runway and its northern extension. The designation was also amended to confirm the Airport Operator’s responsibilities in terms of noise exposure management, monitoring and compliance, to confirm the conditions of the designation in its restrictions on aircraft operations, to establish requirements in terms of monitoring and mitigation, and to provide for the role of the Nelson Airport Noise and Environmental Advisory Committee.
• DAA3 Airport Height Restrictions imposes height limits on activities and structures in order to protect aircraft manoeuvring in and out of the airport, to meet Civil Aviation requirements. The spatial extent of the OLS, a set of spatially defined surfaces associated with operation of the airport’s runway system and above which airspace should be kept free of obstacles, was updated.
